Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website and coaching services offered by iAM360 (collectively, the "Services"). By accessing this website, purchasing, or participating in any program, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, do not use the Services. If you are accepting these Terms on behalf of an organization, you represent that you have authority to bind that organization.

The iAM360 app at app.iam360.ai, including its plans and free trials, is also governed by the App Terms of Service at app.iam360.ai/terms. If these Terms and the App Terms conflict about the app, the App Terms apply.

You must be at least 18 years old and legally capable of entering into a binding agreement to buy a program or plan. The iAM360 app may be used from age 13 with a parent's or guardian's permission, as its own terms describe.

• You are responsible for information you provide to us.
• You agree not to impersonate any person or provide false information.
• You remain responsible for all activities conducted under your email, forms, and communication channels.

Our programs are performance and wellness coaching services. They may include identity-based behavior coaching, training guidance, nutrition frameworks, data-informed insights (for example biometrics and glucose trends), and accountability systems.

You are solely responsible for obtaining advice and clearance from appropriately licensed professionals before beginning or changing any diet, exercise, supplementation, or recovery protocol.

You agree to participate responsibly and to stop any activity that causes distress, injury, pain, or unusual symptoms.

• Follow medical guidance from your licensed providers.
• Disclose relevant health limitations truthfully when requested.
• Use any wearable, lab, app, or tracking tool at your own risk.
• Do not rely on coaching content for emergency decisions.

App plans. Foundation and Performance are subscriptions to the iAM360 app. They start with a 14-day free trial, renew automatically every month or year until you cancel, and can be canceled at any time in the app. A free trial without a card is never charged; it ends by itself and the account moves to the free plan (App Terms 3.2). The App Terms of Service at app.iam360.ai/terms govern app plans, including free trials, renewal, cancellation, failed payments and refunds.

Coaching programs. Executive and other coaching programs are priced individually (Executive on a strategy call) and governed by a written program agreement that sets the price, the billing schedule and any installments. You authorize us to charge your chosen payment method according to that agreement.

For all purchases:

• Fees are in U.S. dollars.
• The price you're shown is the full price. We don't add processing fees. If tax applies to a program, the agreement or invoice shows it.
• Late, failed, or reversed payments may pause access to paid services.

Refunds and cancellations are covered by the separate Refund Policy.

Outcomes vary by person and depend on many factors including baseline health status, adherence, sleep, stress, medical history, and external variables beyond our control. We do not guarantee any specific physical, medical, metabolic, business, or personal result.

Any examples, testimonials, progress metrics, or case studies are for illustrative purposes only.

All content, methods, frameworks, branding, videos, templates, and materials provided through the Services are owned by iAM360 or its licensors and protected by applicable intellectual property laws.

You receive a limited, non-exclusive, non-transferable, revocable license for personal, non-commercial use only.

• No copying, resale, sublicensing, or public redistribution.
• No reverse engineering or derivative commercialization.
• No recording or sharing private coaching sessions without written consent.

You agree not to:

• Use the Services for unlawful or fraudulent purposes.
• Harass, threaten, or abuse staff or community members.
• Upload malicious code or attempt to disrupt platform integrity.
• Misuse confidential program or client information.

To the maximum extent permitted by law, iAM360 and its affiliates, contractors, and representatives will not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages arising from or related to the Services.

Our total aggregate liability for any claim arising out of or relating to the Services will not exceed the amount actually paid by you to iAM360 for the specific Services giving rise to the claim during the 3 months preceding the event.

You agree to defend, indemnify, and hold harmless iAM360, its affiliates, and personnel from claims, liabilities, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the Services, violation of these Terms, or violation of applicable law or rights of any third party.

The App Terms of Service at app.iam360.ai/terms govern the iAM360 app, and these Terms govern the website and coaching services.

Any dispute, claim, or controversy arising from these Terms or the Services will be resolved through final and binding arbitration on an individual basis, except for claims eligible for small claims court.

• Arbitration will be administered by the American Arbitration Association (AAA) under applicable consumer/commercial rules.
• You and iAM360 waive any right to a jury trial and any right to participate in class, collective, consolidated, or representative actions.
• Any arbitration shall proceed only on an individual claim basis.

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-laws principles. If a dispute is found non-arbitrable, exclusive venue will lie in state or federal courts located in Delaware.

We may update these Terms from time to time. Updated Terms become effective upon posting with a revised "Last updated" date.
